Counterclaims and Counterpunches in PIP: Taking the Fight to Medical Providers in PIP Litigation

Presenter(s): Miguel R. Roura, Esq - Partner, Roig Lawyers

Description:  This presentation will discuss the basics of and strategy behind pursuing a counterclaim in PIP litigation. On occasion mistakes are made in the adjusting processes that result in payments when none were owed or outright overpayments to providers. This presentation will cover when and how a counterclaim can be filed pursuant to the Florida Rules of Civil Procedure. Second, we will discuss the causes of action available to an insurer when pursuing a counterclaim, especially a claim for unjust enrichment. We will also address medical provider’s playbook for responding to a counterclaim. Third, we will address the strategy behind a Proposal for Settlement to the Plaintiff Counter-Defendant, when it should be filed and determining how much to offer. Finally, the presentation will conclude with examples of successful counterclaims; including counterclaims regarding clinic licensing, clinic ownership, massage, and unbundling.

Florida vs The Rest of the USA: How Different State PIP/ No-Fault Statutes Can Affect Your Florida Claim - Round 2

Description:  States to be covered in round 2: Kansas, Massachusetts, Oregon and Pennsylvania. This course will discuss the different laws, conditions and exclusions found in other States Personal Injury Protection (PIP)/ First Party (No-Fault) Benefits Statutes and how they will affect a claim and subsequent litigation in Florida. Areas to be discussed include the States who have mandatory PIP Statutes versus choice PIP or First Party benefits Statutes; the different conditions precedents and time limitations within those Statutes; Statute of Limitations; Fee Schedules; Interest; and Attorney’s Fees.

Windshield Defense Litigation Doesn't Have to be a Pain in the Glass
